Raising the Security Status of an Eviction
The new local court rule 4.75 says that in a non-criminal case, anyone may file a letter to request the court raise the security level of the case. When the security level of the case is higher, the case will be hidden from public view.
Steps to increase the security of the case:
Write a letter to the judge.
Address to “Judge” or “To whom it may concern.”
Briefly explain the details of your case.
Be clear and specific about your reason and request.
There is no fee for filing this request, and you can mail, fax, or drop off the letter. Check Case Net about one week after filing the paperwork to see if the case has been removed. You can also call them to follow up on the case.
An example argument for increasing the security level of the case: potential landlords almost always check Case.net to determine whether the applicant-tenant has any recent evictions or landlord/tenant cases – and if they do, the potential landlords typically refuse to rent to that person, increasing the chance that the applicant-tenant will become homeless.
